In accordance with Section 23 of the Taxi and Hire Vehicle Industries Act 2008, the Transport Commission is required to make additional owner-operator taxi licences available in all Tasmanian taxi areas. The number of licences offered in each taxi area is equivalent to 5% of the total number of perpetual taxi licences and owner-operator taxi licences currently on issue in the relevant taxi area.
In accordance with Section 23(3) of the Act, the Transport Commission must not accept a tender that is less than the Reserve Price for a licence in any particular area. These licences must be operated by the holder of the licence (who must be a natural person) and cannot be leased or assigned. They may be cancelled or suspended in prescribed circumstances without compensation.
