Crown Contracts Confidentiality Policy
The Crown Contracts Confidentiality Policy provides that Government contracts must
not contain provisions protecting confidentiality of any information. Prior to 15 September 2012
confidentiality provisions were only able to be included in a contract where an exemption
was granted by a Standing Committee. Such exemptions were only granted in exceptional
circumstances and where the Committee determined that confidentiality, in part or in whole, was in the public interest.
The table below lists contracts that contain confidentiality provisions as a result of an exemption
granted by the Standing Committee.
From 15 September 2012, where specific circumstances are met, a Head of Agency may approve inclusion
of confidentiality provisions in a contract. Those contracts are required to be reported on the
relevant agency’s website and in their annual report.
